Welcome to InHouse Media! By accessing or using our website and services, you agree to these Terms of Use & Service (the “Terms”). Please read them carefully. If you disagree with any part, you may not use our site or book services.
1. Overview
These Terms govern your use of our website, digital platforms, and booking systems, as well as all production services provided by InHouse Media (the “Company,” “we,” “us,” or “our”). Each booking you place constitutes a separate Service Agreement under these Terms.
2. Use of Our Website & Services
You agree to use our website and services lawfully and in accordance with these Terms. You may not:

Use the site for fraudulent, harmful, or illegal purposes

Attempt to gain unauthorized access to our systems or data

Copy, reproduce, or redistribute content without written permission
We may suspend or terminate access if you violate these Terms.
3. Booking & Project Engagement
When you book a project, you engage InHouse Media to provide real estate media services (photography, videography, drone, 3D tours, listing websites, and related marketing deliverables).
Each booking creates a Listing Production Agreement between you (“Client”) and the Company.
By booking, you agree:

All information provided is accurate and complete

You have authority to book services for the property

To prepare the property for production as outlined below
4. Independent Contractor Relationship
InHouse Media operates as an independent contractor. Nothing in these Terms creates a partnership, joint venture, or employment relationship. You acknowledge:

We control our methods, processes, and tools

You may set deadlines or quality expectations, but not direct daily operations

We may accept or decline projects at our discretion
5. Payments
All fees are due as specified on your invoice or at the time of booking.
Deliverables are withheld until payment is received in full unless prior arrangements are made.
Late Fees: Unpaid balances accrue 10% every 30 days.
Travel Fees: Projects outside our standard service area may incur $100/hour per person.
Weekend Fees: Weekend shoots may include up to $300/crew member surcharge.
6. Cancellations & Rescheduling

Must be made at least 24 hours in advance

Changes within 24 hours incur a 25% fee of total invoice

Weather-related changes are allowed; however, we may postpone if unsafe or unsuitable

On site cancellations where we arrive but are unable to complete the work result in a minimum of a $75 fee but may go up to 25% of the total order cost.
7. Job Site Requirements
Client is responsible for preparing the property before arrival:

Property must be clean, staged, and ready
-
Pets must be removed
-
No safety hazards may be present
-
We photograph/film “as-is” and may decline unsafe or obstructed sites
We do not move furniture, décor, or perform cleaning.
8. Reshoots & Revisions
-
Reshoots due to client preference: $150/hr/person
-
Photo Revisions: $20 per image
-
Video Revisions: One complimentary cycle; additional $100/hr
-
Requests must be submitted within 2 business days of delivery
9. Turnaround Times
Typical delivery timelines (unless otherwise noted):

Photos / 3D Tours / Listing Sites: 1 business day

Highlight Videos: 3 business days
-
Luxury / Cinematic Videos: 3–5 business days
Rush edits available for an additional fee.
10. Hosting & Renewals

3D Virtual Tours: 3 months free hosting → $60 annual renewal
-
Listing Websites: 1 year free domain hosting → $25 annual renewal
Hosting renewals are optional and billed annually.
11. Intellectual Property & Licensing
All content created by InHouse Media (the “Intellectual Property”) remains our sole property. Upon full payment, we grant you a limited, non-exclusive license to use final deliverables for marketing the specific property.
You may not:

Transfer or sell content to third parties (e.g., stagers, builders, other agents) without permission

Modify deliverables without written consent

Claim ownership or authorship of our work
Third-party use (builders, stagers, etc.) requires a separate license.
We reserve the right to use content for our portfolio, marketing, and advertising unless you request removal of identifiable branding or likeness.
12. Media & Location Releases
You grant permission for us to capture media at the booked property and use it for marketing and portfolio purposes.
You are responsible for obtaining property access and permissions.
13. Dispute Resolution
If a dispute arises:

Negotiate in good faith within 30 days

If unresolved → Mediation in Denver, Colorado
-
If still unresolved → Binding Arbitration per AAA rules
Each party bears its own legal fees unless the arbitrator awards otherwise.
14. Limitation of Liability
We strive for quality and accuracy, but we are not liable for:

Errors or omissions on the website or deliverables
-
Losses from reliance on content or delays
-
Indirect, incidental, or consequential damages
Maximum liability is limited to the total fee paid for the project.
15. Indemnification
You agree to indemnify and hold harmless InHouse Media, its employees, and contractors from any claims, damages, or losses arising from your use or misuse of our services, content, or site.
16. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.
17. Modifications
We may update these Terms at any time. Continued use of our site or services after changes means you accept the updated version.
